The closure of the Beijing Office has obviously increased the cost of local governments sending people to intercept and receive petitioners, making the second method more desirable: outsourcing the interception of petitioners to security companies. Security companies intercept, detain and repatriate petitioners for local governments. Including stationing in Beijing, outsourcing and "cancelling numbers", the fear of local governments for petitions has spawned a huge stability maintenance "market", where various rent seekers, brokers, and thugs seek food. Whether it is the Beijing Office, security companies, or officials of the Petition Bureau, they all share the benefits in this rent-seeking field, maintaining and expanding the "stability maintenance" pie. As this "market" expands, even if it has no direct connection with "maintaining stability", it can be used as a pretext for "rent-seeking".
The gray market of intercepting visits, outsourcing and canceling registrations exists mainly because of the stability maintenance system itself. Take petitions as an example. In the actual operation of petitions, petitions are either "intercepted" or "cancelled", and the "lower-level information transmission" function that petitions should have is almost ineffective. However, from the source of institutional design, due to the delicate relationship between the central and local governments, its positioning itself contains a paradox.
According to Ying Xing, dean of the School of Social Sciences at China University of Political Science and Law, the passage of the "Provisional Regulations on Petitions of Party and Government Organs (Draft)" in 1982 marked a turning point in the petition system: unlike the mass mobilization and class struggle in the Mao era, the petition system in the new era serves the overall situation of economic construction and stability and unity.
In Ying Xing's view, the shift from mass mobilization and class struggle to economic construction and stability and unity will inevitably lead to the issue of "maintaining stability". Since many local governments are dominated by economic construction, they are not representatives of public interests on issues such as farmers' burdens, land disputes, layoffs, and housing demolition compensation, but rather as subjects with their own interests, and are bound to have a tendency to directly conflict with the interests of the parties involved.
At the same time, with the disintegration of the people's communes and the advancement of state-owned enterprise reform, the control capacity of grassroots units has weakened, and the ability and space for urban and rural residents to seek self-interest expression has increased day by day. More importantly, with the progress of reform and opening up, the awareness of citizens' rights has increased, and the previous administrative means seem to be ineffective.
Ying Xing believes that on the one hand, petitions highlight the order demands for stability and unity and require that conflicts be kept at the grassroots level. On the other hand, as one of the central government’s means of restricting grassroots governments, they encourage petitioners to “resist according to law” in certain circumstances.
The conflict between these two goals puts petitions in an unjustifiable paradox: on the one hand, the central government hopes to have a mass line to supervise local governments, so it insists on the petition system; on the other hand, it does not want to affect the work of the central government, so Local governments are required to strictly control petitions and nip "instability factors in the bud" and digest them at the grassroots level. Under this idea of focusing on "blocking" and not expanding the channels for sorting out, once unstable events such as collective petitions occur, local governments can only resort to extraordinary measures.
Due to the lack of procedural and legal effectiveness, the petition system cannot effectively end conflicts and disputes; and the underlying reason behind this is the arbitrariness of power. At the same time, the mechanism for terminating conflicts in the judicial process dominated by power is also weak.
The “stability maintenance” system is adapted to the problems faced by the country during its transition period and expands as social conflicts intensify. To break the vicious circle of stability that "the more stability is maintained, the more unstable it becomes", as Professor Sun from Tsinghua University pointed out, it is necessary to transform government functions and establish a limited government; improve the legal mechanism to resolve social contradictions and conflicts; and establish a balance of interests under market economy conditions. mechanism; promote the development of civil organizations.
The most important ones can be summarized in two words: "rule of law". Governing the country in accordance with the law and building a socialist country under the rule of law is the direction of political system reform proposed in the report of the 15th National Congress of the CPC Central Committee. On March 10, 2011, the Chairman of the Standing Committee of the National People's Congress announced that a socialist legal system with Chinese characteristics has been formed.
However, the pace of reform of the political system, especially the reform of the judicial system, still needs to be accelerated. A judiciary that is fair, efficient, credible, and capable of restraining public power is a "pressure reducing valve" for society. Promote the reform of the judicial system so that courts can truly independently exercise their powers in accordance with the law, and social conflicts can also be brought into the orbit of the rule of law.
Secondly, democracy should be gradually expanded. The people are the masters, and the citizens are the masters of the country. As big as the change of government or as small as the increase or decrease of water prices, if citizens hold the votes, participate in hearings, have the right to vote, and express their opinions in a reasonable manner, most of the unstable factors can naturally be eliminated.
Thirdly, the ruling party should change its thinking on governing and enhance its ability to govern. The experience of various countries around the world shows that social conflicts in modern society are not only inevitable, but also an inevitable phenomenon for the healthy functioning of society. In this regard, on the one hand, the government regulates its own laws and does not cross boundaries, does not break the law, and does not create unstable factors; on the other hand, it liberalizes civil organizations and cultivates civil society. Once a conflict occurs, there are independent courts to judge and independent non-governmental organizations. Mediation, natural stability and unity, social stability, and long-term peace and order.
With the formation of the socialist legal system with Chinese characteristics, we have reason to expect that the law will not only become people's "shield", but also become a weapon for stabilizing society.
